Biometric residence permits are being introduced for more immigration categories

From Wednesday 29 February 2012, all applicants in the UK will need to obtain a biometric residence permit if they are applying to stay here for more than 6 months. This page explains how you can apply to remain in the UK as a dependent relative of a person who has limited leave to enter or remain as a refugee or person granted humanitarian protection.

If you are a parent, grandparent, child relative under the age of 18 or other dependant relative of a person with limited leave to enter or remain in the UK as a refugee or beneficiary of humanitarian protection, you can apply for permission to remain in the UK (known as 'leave to remain').

The following relatives can apply to extend their stay as a dependant relative in the UK:

  • widowed mothers and widowed fathers aged 65 or over; and
  • parents or grandparents who are travelling together, if one of them is aged 65 or over.

You must provide evidence that:

  • you are wholly or mainly financially dependant on your relative.
  • you (and any dependants you have) can and will be maintained and housed adequately, without recourse to public funds, in accommodation which your settled relative owns or occupies exclusively; and
  • you have no other close relatives in your own country who can support you financially.

If there are exceptional compassionate circumstances, the following relatives who meet the above requirements may be allowed to extend their stay as a dependant relative of a person with limited leave as a refugee or beneficiary of humanitarian protection here:

  • sons, daughters, sisters, brothers, uncles and aunts over the age of 18; and
  • parents and grandparents under the age of 65.

A child relative of a person with limited leave to enter or remain as a refugee or beneficiary of humanitarian protection under the age of 18 can apply to extend their stay here if they:

  • were previously granted leave to enter as the child of a relative with limited leave to enter or remain in the UK as a refugee or beneficiary of humanitarian protection;
  • are not leading an independent life;
  • are not married or in a civil partnership;
  • have not formed an independent family unit; and
  • are aged under 18.

If you are applying to extend your stay here as a dependent relative of a person with limited leave to remain or enter as a refugee or beneficiary of humanitarian protection, you should complete application form FLR (P).
