If the result of the check is positive it will clarify for the employer that the applicant has the right to work at the point of recruitment and recruitment can continue, but on its own does not establish a defence for the employer.
If the applicant is recruited following the employer checking service response, the employer should check the original documents at the earliest opportunity and all records and documents relating to the employee should be retained securely.
Where an employer checks the work entitlement or proof of identity of an application registration card (ARC) and the result is negative, the job applicant should be advised to contact the UK Border Agency to clarify the conditions of their stay in the United Kingdom.
