This section explains what an organisation must do if it takes over an existing sponsor organisation. It also explains what an existing sponsor should do if it is taken over in full or in part by another organisation and some of its migrant workers transfer to that organisation, or if it carries out a demerger and some migrant workers transfer to the new organisation.

If an employer is taken over, any of its employees who transfer to the new organisation are covered by the Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE). You can find more information about TUPE on the UK government's Business Link website.

Additional notifying responsibilities

Tier 4 sponsors must also, where required, notify their inspection or accreditation body of any change in their ownership.
